Understanding Advance Tax & Presumptive Taxation (Section 44ADA)

What is Section 44ADA?

Section 44ADA of the Indian Income Tax Act offers a simplified taxation scheme for specified professionals whose gross annual receipts do not exceed ₹75 Lakhs (provided 95%+ payments are received digitally).

Instead of tracking every coffee, software subscription, and laptop depreciation expense, you simply declare 50% of your gross revenue as profit. The remaining 50% is automatically deemed as legitimate business expenditure.

Advance Tax Due Dates & The March 15 Exemption

Regular taxpayers must pay advance tax in four quarterly installments: 15% by June 15, 45% by Sept 15, 75% by Dec 15, and 100% by March 15.

However, professionals filing under Section 44ADA have a special statutory benefit: You are permitted to pay your entire 100% advance tax in a single payment on or before March 15th without incurring any interest penalty under Section 234C.

Frequently Asked Questions (Advance Tax & 44ADA)

Who is required to pay Advance Tax in India?↓
Under Section 208 of the Income Tax Act, any individual, freelancer, or business whose estimated total tax liability for the financial year (after deducting TDS credits) equals or exceeds ₹10,000 must pay advance tax in quarterly installments.
What is the special Advance Tax benefit under Section 44ADA for professionals?↓
Under Section 44ADA, eligible professionals (software engineers, UI designers, content creators, doctors, technical consultants) are permitted to pay 100% of their advance tax in one single installment on or before March 15th of the financial year, rather than four quarterly installments, without attracting delay interest under Section 234C.
What is presumptive taxation under Section 44ADA?↓
Section 44ADA allows professionals with annual gross receipts up to ₹75 Lakhs (if 95%+ payments are received digitally) to declare a minimum of 50% of gross revenue as presumptive profit. You only pay income tax on that 50%, and you do not need to maintain tedious expense bills or audits.
How does client TDS (Section 194J) affect my Advance Tax?↓
TDS deducted by your clients under Section 194J (10% or 2%) or Section 194C (1% or 2%) is a direct advance credit against your total tax liability. Your advance tax liability is strictly: Total Computed Tax minus TDS Credits already reflected in your Form 26AS or AIS.
What are the penalties for missing Advance Tax deadlines?↓
If you fail to pay your quarterly installments or pay less than 90% of the total tax assessed by March 31st, interest penalties of 1% per month apply under Section 234B (for default in payment) and Section 234C (for deferment of quarterly installments).
Where can I pay my Advance Tax online?↓
You can pay advance tax directly on the official Income Tax e-Filing portal (eportal.incometax.gov.in) using the "e-Pay Tax" facility. Select Assessment Year 2026-27 (or current AY) and choose Minor Head "(100) Advance Tax" under Challan 280.
